씨제스는 소속 배우 류준열에 대한 일부 네티즌들의 온라인상 허위사실유포, 모욕 등의 행위에 대해서 적극적으로 법적 대응을 하고자 합니다.
 
2016. 2.말경 한 네티즌이 ‘류준열은 일베’라는 취지의 허위 게시물을 업로드한 사실이 있었고, 해당 게시물을 삭제한 이후에도 빠른 속도로 배우 류준열에 대한 근거 없는 허위 게시물이 파생되기에 이르렀습니다.

씨제스는 즉시 ‘류준열은 일베 활동을 한 사실이 전혀 없다’고 언론을 통해 분명한 입장을 밝혔으며, 류준열 본인도 공식 채널을 통해 자신은 일베 회원으로 활동한 사실이 전혀 없다는 사실을 알렸습니다. 더불어 씨제스는 류준열의 아이디로 일베 사이트에 가입하려고 하는 수십 건의 IP를 찾아내어 경찰에 신고하고, 억측과 루머에 대하여 강력히 대응하겠다고 밝혔으나, 악성 댓글과 게시물은 지속적으로 업로드 되었습니다.

이에 씨제스 법무팀은 수십 명의 악플러를 고소 하였습니다. 당시 피고소인들과 그 가족들은 씨제스에 탄원서를 보내거나, 전화 또는 방문을 통하여 선처를 호소하기도 하였습니다. 그러나 씨제스는 사전에 수차례 경고한 바와 같이 고소를 취하하지 않았고, 서울중앙지방검찰청, 부산지방검찰청, 광주지방검찰청 등으로부터 피고소인들이 각 교육이수조건부 또는 보호관찰소선도위탁조건부로 기소유예 처분을 받거나 정보통신망이용촉진 및 정보보호 등에 관한 법률 위반(허위 사실에 의한 명예훼손)혐의로 벌금형이 내려졌다는 통지를 받았습니다.

이와 같은 법적 대응에도 불구하고, 배우 류준열의 명예를 훼손하고 인격을 모욕하는 네티즌들은 최근까지도 발견되고 있습니다. 비방할 목적 하에 악의적으로 배우의 발언을 조작하여 특정 이슈와 연관시키는 등 허위사실을 유포하여 배우의 명예를 훼손하거나, 인신공격성 댓글과 게시물로 배우를 모욕하는 행위는 모두 명백한 범죄에 해당합니다.

앞으로도 씨제스는 악성 루머와 허위사실, 그리고 인신공격을 내용으로 하는 게시물, 댓글로 배우를 비롯한 여러 사람들의 명예와 인격을 훼손하는 사이버 범죄에 대하여 민ㆍ형사상 조치를 불문하고 강경하게 대응할 예정입니다. 씨제스는 그 일환으로 허위 게시물의 유포자 및 악성 댓글을 작성한 네티즌들에 대하여 최근 다시 한 차례 정보통신망 이용촉진 및 정보보호 등에 관한 법률 위반(명예훼손) 및 모욕 등 혐의로 서울중앙지방검찰청에 고소장을 제출하였습니다. 
 
비방할 목적으로 정보통신망에 허위사실을 적시하여 사람의 명예를 훼손하는 경우 정보통신망 이용촉진 및 정보보호 등에 관한 법률에 의하여 처벌을 받게 됨은 물론 사실을 적시하지 아니하더라도 사람의 사회적 평가를 저하시킬 만한 추상적 판단이나 경멸적 감정을 표현하는 경우 형법상 모욕죄에 의하여 처벌을 받을 수 있습니다(대법원 2003. 11. 28. 선고 2003도3972 판결 참조).  

씨제스가 고소장에 첨부한 증거자료에는 근거 없는 허위사실과 인신공격성 발언이 기재된 각 포털사이트의 기사 댓글, 카페 커뮤니티 게시글 및 댓글 캡처본이 포함되어 있습니다.  이와 같이 개인의 인격권을 침해하고 배우의 사회적 평가를 저하시키고자 하는 악의적인 의도가 담긴 글들을 게시하는 것은 일반적으로 허용된 표현의 자유를 넘어선 것으로서 범죄에 해당할 수 있다는 점을 주의하여 주시기 바랍니다.

향후 배우 류준열을 상대로 한 사이버 범죄행위를 발견한 팬 여러분들은 해당 화면을 캡처한 후 원 게시물의 링크와 함께 <cjes.junyeol@gmail.com>로 제보해서 불법행위의 근절에 협조해 주시기 바랍니다.

C-JeS is actively taking legal action with regards to the acts of some netizens who are involved in the dissemination of false facts and insults towards actor Ryu Jun-yeol, who is a part of our company. 
On March 2016, a netizen uploaded a false post regarding actor Ryu Jun-yeol who was said to make the ‘Daily Best Post’ in DC Inside - a website that has gained notoriety in Korea. Even after the post was deleted, false rumors regarding Ryu Jun-yeol have spread.

C-JeS immediately reported to the media that, “Ryu Jun-yeol has never done any activities with regards to the Daily Best Posts,” and made a clear statement on their position. Actor Ryu Jun-yeol himself also announced that he never acted as a member of DC Inside through his official channel. In addition, C-JeS has reported dozens of IP addresses that tried to sign up for the website using Ryu Jun-yeol’s ID and announced that they would strongly respond to speculation and rumors but malicious comments and posts were constantly uploaded.

Because of this, C-JeS legal team formally sued dozens of malicious commentators after consulting this matter with Ryu Jun-yeol. At that time, the respondents and their families sent their petitions to C-JeS or appealed to the company through visitation and calls.

However, C-JeS has not withdrawn the complaints as these respondents were warned several times in advance. The accused parties were prosecuted under conditional or provisional inspection, or were fined for violating the Act on the Promotion of Information Network Usage and Information Protection, etc. (defamation by false facts) by Seoul Central District Prosecutors' Office, Busan District Prosecutors' Office, and Gwangju District Public Prosecutors Office.

Despite this legal action, netizens who defamed the honor and insulted the character of actor Ryu Jun-yeol are still being searched for until now. The malicious act of manipulating the actor's remarks and relating them to specific issues for the sake of defamation, defaming the actor's reputation through disseminating false facts, or insulting the actor with aggressive comments and posts are all obvious crimes.

Moving forward, C-JeS will continue to take strong legal action to cybercrime that damages the honor and character of actors and other people through posts and comments of malicious rumors, false facts, and attacks, whethe through civil or criminal measures. As a part of this, we filed complaints on netizens who allegedly posted false posts and negative comments as they violate the Act on the Promotion of Information Network Usage and Information Protection, and posting libel, etc. as defamation by false facts
